ACTION: Legislative Recommendations for the 88th Texas Legislature

- Close ethics loopholes for charter school leaders.
- Make charter superintendents subject to the same limits on related party transactions as public school superintendents. Currently, charter superintendents can benefit from work for private entities that do business with their schools, including real estate transactions.
- Extend the charter nepotism laws to all charters. Nepotism laws enacted in 2013 grandfathered in existing charters so that they can still employ family members.
- Apply the state’s students’ data privacy laws to protect charter student’s data.
- Apply state laws on parental rights to charters schools, such as the right to review all teaching materials.
- Give charter parents the right of informed choice. Parents often assume that charter schools offer the same services, programs, and teacher qualifications as public schools, such as certified teachers, transportation, counselors, or services for special education students. Charters should make this information easily accessible before parents apply to a charter.
- Remove enrollment barriers at charter schools to allow equal access to all students.
- Change the law on discipline exclusion so that charter schools serve all students.
- Consider the percentage of special education students served by a charter before approving a charter expansion.
- Guarantee public input and notice for charter school expansions.
- Require that charters notify the general public immediately after a charter board approves the submission of a charter amendment.
- Post the complete charter amendment request on the TEA website similar to new charter application.
- Require that charters hold a public meeting for expansions, similar to the meeting required for a new charter application.
- Give the State Board of Education the authority to approve new charter campuses through the amendment process.
- Stop giving “small district” funding to charter schools that have more than 5,000 students. All charters, regardless of size, receive the average per student funding through the allotment intended to help small school districts (5,000 and under) with economy of scale. * IDEA Public Schools with 68,000 students received $68 million from the allotment in 2021-22, while a public school district of similar size received zero.

The Texas State Board of Education's 88th Adopted Legislative Priorities
1. Charter Approval Process
a. Grant SBOE veto authority over charter expansions (Adopted 14-0)
b. New charters approved by SBOE would be granted a charter for 3 years, and return to SBOE for progress report and veto/no action prior to being granted a permanent charter (Hickman) (Defeated 6-6)

2. Charter Regulation

- DISCUSSION (No Action): Board opportunity to discuss Additional Requirements for Social Studies Classes, grades 3rd-12th.
- ACTION: This item presents for first reading and filing authorization, to move the implementation year for the TEKS for Biology, Chemistry, Integrated Physics and Chemistry, and Physics to the beginning of the 2024-2025 school year to align with the instructional materials timeline. The proposed amendment would also align with the implementation timeline for the Kindergarten-Grade 8 science TEKS and the TEKS for all other high school science courses.
- ACTION: This item presents for second reading and final adoption, to update the rules related to local operations and certification requirements from school districts.

- ACTION: Amendments to Proclamation 2024 of the State Board of Education Advertising for Bids on Instructional Materials. This item provides an opportunity for the State Board of Education to approve amendments to the schedule of adoption procedures in Proclamation 2024, amending the deadline for submitting preliminary and final correlations, pre-adoption samples, and related deliverables. Proclamation 2024 calls for instructional materials for science, technology applications, specified courses in career and technical education, and Personal Financial Literacy and Economics.
- ACTION: Approval of Proclamation 2024 Questions and Answers. Proc 2024, calls for instructional materials for science, technology applications, specified courses in career and technical education, and Personal Financial Literacy and Economics. Publishers and other stakeholders were given an opportunity to ask questions at a Proclamation 2024 introduction meeting held in June 2022 and subject-specific meetings held in July and August 2022 and encouraged to submit additional questions through email. Questions from publishers were added to existing questions common to all proclamations, and the resulting question and answer document for Proclamation 2024 is presented for SBOE approval.
- ACTION: Ratification of Texas Essential Knowledge and Skills Coverage in Materials Selected for the Texas Resource Review. This item provides the opportunity for the State Board of Education (SBOE) to ratify the report from the Texas Essential Knowledge and Skills (TEKS) review committees regarding coverage of the TEKS in materials that were selected for the Texas Resource Review (TRR). This item presents the final report from the commissioner of education regarding the coverage of the TEKS. Please note: The TXSBOE has no authority and no oversight of the TRR. Therefore, I will vote NO. The TXSBOE cannot and should not be a rubberstamp for the Texas Education Agency.
- ACTION: Approval of Long-Range Plan for Technology. This item provides the opportunity for the board to approve the updated Long-Range Plan for Technology (LRPT) 2018-2025. Upon approval, staff will post the updated LRPT on the Texas Education Agency (TEA) website for use as guidance to Local Education Agencies (LEAs) when planning technology needs for the upcoming school year. Statutory authority is the Texas Education Code (TEC),

Making Connections I-IV (approved for 5 more years)
The Making Connections course sequence serves students who have an autism spectrum disorder or a related disorder such as social (pragmatic) communication disorder which causes them to have difficulty with social skills. The courses also assist the students with developing and generalizing appropriate and beneficial social skills and in turn increases that student’s postsecondary outcome.
Making Connections I assists the students in developing an understanding of autism and other related disorders. The course also assists the students in developing and generalizing appropriate and beneficial social skills and in turn increases that student’s postsecondary outcome.

Peace Keepers I-II (approved for 5 more years)
PeaceKeepers is a curriculum-driven mediation program which trains high school students in all aspects of the mediation process. Those students then mediate peer conflicts resolving them in a peaceful manner. PeaceKeepers is designed to provide skill development and knowledge acquisition in mediation plus substantial field experience to young people who are interested in careers in education and/or related helping professions. Participants will receive intensive 4 to 6 weeks of classroom training in skill-building mediation activities. After this training, mediators will implement a campus-wide mediation program as their field practicum. Classroom activities will continue to build skills, knowledge, and bonding for the group. Positive peer influence through nonviolence will be a central strategy for addressing such issues as conflict resolution, anger management, low academic achievement, dropout prevention, behavior problems, and negative attitudes toward school, in addition to other issues of concern in the school/district. Outside evaluation has shown significant results.
